Trade Marks
UK law defines a trade mark as: “Any sign capable of being represented graphically which is capable of distinguishing goods and services of one undertaking from those of other undertakings.”
Commonly, trade marks are in the form of a word, a device (logo) or a combination of the two. However, other “signs” such as the shape of a product or its container, sounds or even smells may potentially be registered as trade marks.
Designs
Registered design protection is a legal monopoly for the “shape and appearance” of an article that gives the owner exclusive rights over use of the design. Protection is granted on the basis of purely visual representations of the design in question. It can be an important protection for certain articles which, for example, may not be capable of patent protection.
